1. Scope
These Terms and Conditions govern the business relationship between the client and Rent a Nanny Mallorca, hereinafter referred to as the “Agency”.
The Agency provides the following services:
1. Placement of professional self-employed childcare providers for hourly, short-term or project-based assignments
2. Recruitment of qualified childcare professionals for long-term employment in private households, full-time or part-time
The version of these Terms and Conditions valid at the time of engagement shall apply.
2. Placement of Qualified Childcare Professionals for Temporary Assignments

2.1 Subject of the Service
Rent a Nanny Mallorca places qualified childcare professionals for hourly, temporary or project-based assignments on Mallorca.
The childcare professionals operate as self-employed and properly registered service providers and perform their services independently.
The childcare agreement is concluded exclusively between the client and the childcare professional.
Rent a Nanny Mallorca is not a party to the childcare agreement and does not itself provide the childcare service.
2.2 Role of the Agency
As part of the placement process, the Agency undertakes the selection, coordination, organisation and documentation of suitable childcare professionals based on the information provided by the client.
The placement service includes, in particular, the review of the request, matching with suitable childcare professionals from the Agency’s professional network, preparation of a non-binding childcare proposal, provision of an anonymised short profile and organisational coordination up to the release of contact details. After full payment has been received and the required invoicing details have been provided, the Agency transmits the full profile / dossier and contact details of the childcare professional.
No guarantee is given regarding the availability of individual childcare professionals or the conclusion of a childcare arrangement.
2.3 Availability and Conditions of the Childcare Professional
The childcare professionals
• organise their schedules independently
• determine their own conditions, in particular hourly rates, possible flat fees, travel costs and other assignment-related expenses
• coordinate the final assignment details directly with the client
• invoice their services directly to the client
Availability can often only be confirmed closer to the requested period, especially during holiday seasons or in the case of short-notice requests.
Amounts indicated by the childcare professional are generally stated as final amounts including IVA. The actual invoicing is carried out exclusively by the self-employed childcare professional.
2.4 Service/Coordination Fee
A one-time service/coordination fee is charged for selection, coordination, organisation, documentation and release of contact details.
The amount of the service/coordination fee is communicated transparently to the client as a final amount including statutory IVA before binding engagement.
The service/coordination fee is payable immediately upon binding engagement.
A binding engagement exists as soon as the client expressly confirms the placement, for example by giving a “GO” in text form, and initiates payment of the service/coordination fee.
The release of contact details and transmission of the full profile / dossier will only take place after full payment has been received and the required invoicing details have been provided, for example full billing address, passport number or NIE.
Once the contact details have been released, the Agency’s service for the respective placement is deemed to have been performed.
Once the contact details have been released, the service/coordination fee is non-refundable, as the agreed Agency service has already been performed at that point. Mandatory consumer rights remain unaffected.
The service/coordination fee is due regardless of whether the client ultimately makes use of the placed childcare service, provided that the contact details have already been released.
2.5 Childcare Costs, Flat Fees, Travel Costs and Expenses
The childcare costs are agreed and settled directly between the client and the childcare professional.
Depending on the assignment, the childcare costs may be calculated on the basis of an hourly rate or an individually agreed flat fee.
Travel costs and other assignment-related expenses, where applicable and agreed, are also coordinated and settled directly between the client and the childcare professional.
Rent a Nanny Mallorca does not issue invoices for the childcare service, travel costs or other expenses of the childcare professional.
2.6 Scope of the Placement Service
The Agency’s placement service is deemed fully performed once, after receipt of payment, at least one suitable childcare professional has been released to the client with full profile / dossier and contact details, provided that this childcare professional
• meets the essential criteria of the request
• is generally available for the requested assignment
• has confirmed interest in the assignment
There is no entitlement to unlimited further proposals.
If a proposed childcare professional is no longer available before the release of contact details, the Agency will make reasonable efforts to provide an alternative proposal where possible. No guarantee is given for a successful replacement placement.
2.7 Client Protection
Follow-up bookings with childcare professionals introduced by Rent a Nanny Mallorca must be handled through Rent a Nanny Mallorca within 18 months.
This applies regardless of whether the follow-up booking is made directly or indirectly.
Circumventing the Agency by directly engaging a previously introduced childcare professional within this period is not permitted.
3. Recruitment of Qualified Childcare Professionals for Long-Term Employment
3.1 Subject of the Service
Rent a Nanny Mallorca recruits suitable childcare professionals on behalf of the client for long-term employment within a private household.
Prior to binding engagement in text form, the Agency may carry out a non-binding preliminary review of potential candidates from its existing network or applicant pool.
Active recruitment in the sense of a structured candidate search begins only after engagement in text form and receipt of the agreed assignment fee.
3.2 Basis for Calculating the Placement Fee
The placement fee is based on the effective gross annual compensation package of the position to be filled.
This includes in particular:
• the regular base salary
• contractually agreed additional payments
• benefits in kind, to the extent that they form part of the overall compensation package, for example accommodation or meals
3.3 Recruitment Process and Fee Structure
Recruitment follows a two-stage model.
1. Assignment Fee, Start of Recruitment
Upon engagement, an individual assignment fee is agreed.
The amount of the assignment fee may vary depending on the scope and complexity of the search assignment.
The active recruitment process begins once the engagement has been confirmed in text form and the agreed assignment fee has been received.
The assignment fee remunerates the Agency’s initial work. In the event of a valid withdrawal, mandatory consumer rights, in particular the rules on proportional compensation in the case of expressly requested early commencement of the service, remain unaffected.
2. Placement Fee upon Successful Hire
In the event of a successful placement, a placement fee is charged.
The amount depends on the type and scope of the search assignment and typically ranges between 10 % and 15 % of the effective gross annual compensation package, plus statutory VAT / IVA.
The Agency generally offers the following search models:
Standard Placement
approx. 10 % of the gross annual compensation package
Premium Search
approx. 12 % to 15 % of the gross annual compensation package
Premium search assignments may include, for example:
• Live-in Nanny
• Rota Nanny
• multilingual or specialised childcare professionals
• Travel Nanny
• positions in high-profile households
The placement fee becomes payable upon
• conclusion of an employment contract between the client and a childcare professional introduced by Rent a Nanny Mallorca
or
• the actual commencement of work by the introduced childcare professional within the client’s household
A successful placement shall also be deemed to have occurred if the client enters into an employment relationship with a candidate within 18 months of the introduction, or if the candidate actually starts working.
The Agency’s entitlement to the fee exists regardless of whether the contact is established directly or indirectly.
This also applies if the employment takes place through third parties, affiliated companies, family members or other households, provided that the contact can be traced back to a prior introduction by Rent a Nanny Mallorca.
The sharing of candidate profiles or contact details with third parties is not permitted and, if it results in employment, shall also be deemed a successful placement within the meaning of these Terms and Conditions.
4. General Provisions
4.1 Confidentiality
All information provided by the Agency regarding childcare professionals must be treated as confidential and is intended exclusively for the respective client.
The sharing of profiles, dossiers, contact details or other information with third parties is not permitted without the prior consent of Rent a Nanny Mallorca.
4.2 Duty of Supervision
During the childcare period, the legal guardians transfer the duty of supervision to the childcare professional within the legally permissible scope.
The specific organisation of the childcare, working times, handovers, child-specific information and safety-relevant details must be coordinated directly between the client and the childcare professional.
4.3 Liability
Rent a Nanny Mallorca accepts no liability for the behaviour, actions or omissions of the introduced persons during childcare.
The Agency is liable only in cases of intent or gross negligence within the scope of the applicable legal provisions.
Liability for damages arising from injury to life, body or health remains unaffected in accordance with statutory provisions.

5. Right of Withdrawal for Distance Contracts
Consumers within the meaning of the applicable legal provisions generally have a statutory right of withdrawal for contracts concluded outside business premises or through distance communication.
The withdrawal period is 14 days from the date of conclusion of the contract.
To exercise the right of withdrawal, the client must inform Rent a Nanny Mallorca of their decision to withdraw from the contract by means of a clear statement, for example by email or in writing.
To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of the right of withdrawal is sent before the withdrawal period has expired.
5.1 Early Commencement of Services
The client expressly agrees that Rent a Nanny Mallorca may begin performing the commissioned services before the withdrawal period has expired.
This may include in particular:
• consultation and clarification of the requirement profile
• review of the request and internal candidate research
• matching with potential childcare professionals from the Agency’s network or applicant pool
• preparation and transmission of candidate profiles
• organisational coordination within the placement or recruitment process
• documentation and release of contact details
If the client withdraws from the contract after the performance of the service has already begun, the client shall pay an appropriate amount corresponding to the proportion of services already provided up to the time of withdrawal in relation to the total scope of the planned service.
The right of withdrawal expires prematurely if the service has been fully performed and the client has previously expressly agreed that Rent a Nanny Mallorca may begin performing the service before the withdrawal period has expired.
In the placement of temporary childcare professionals, the service is deemed to have been fully performed in particular once, after receipt of payment, the full profile / dossier and contact details of a suitable childcare professional have been released.
Mandatory consumer rights remain unaffected.
6. Acceptance of the Terms and Conditions
By engaging the Agency or paying a service/coordination fee, an assignment fee or a placement fee, the client confirms that they have taken note of and accepted these Terms and Conditions.
The Terms and Conditions are provided to the client on a durable medium as part of the engagement process and are additionally available on the website of Rent a Nanny Mallorca.
7. Final Provisions
Spanish law shall apply.
The competent court in Palma de Mallorca shall have jurisdiction, where legally permissible.
These Terms and Conditions are provided in German and English.
In case of doubt, the German version shall prevail.
